Effective Date: 1st June 2023. 

The given privacy policy (“Privacy Policy”) is to be read in conjunction with the terms and conditions as displayed on Our Platform/Website (includes the URL www.ardentous.com, www.dental-stack.com  and Dental Stack Web Portal and Dental Stack Mobile Application and any products sold by the Company that in any form collects data of the end users) and establishes a legally binding agreement between the User and Ardentous Technologies Private Limited (“The Company”).  

Any reference in the form of “we”, “us” and “our” would hereinafter refer to the Company. Any person who accesses or uses the Platform/Website shall be termed as the “User”, any reference to “You”, “Their”, “Them” shall hereinafter refer to the User.  

Your access and/or usage of the Platform/Website indicates that you have read, understood and agreed in full to this Privacy Policy.  

In the pursuance of our legal commitments, we have drafted and displayed this Privacy Policy and You agree that any information You share with us, is only after voluntarily consenting to this Privacy Policy.  

If You do not agree with this Privacy Policy, then please do not access or use the Platform/Website. 

What Personal Information May Be Collected 

In the course of providing services, the Company may have to collect, store and retain certain Personal Information from you. This information would, inter alia, include the following: 

Personal Details: The Company may collect personal details including but not limited to name, and age.  

Geographical Information: The Company may collect information pertaining to your geographical location and associated details such as pin code, address, google map URLs etc.  

Contact information: The Company may collect any contact information from You including but not limited to your address, email and telephone number. 

Health records/data: The Company may collect health-related information including but not limited to test reports, x-ray reports, prescriptions and progress images of the body parts/areas being treated. 

Professional Information: Relevant information including but not limited to relevant licenses, registration details, professional certificate to practice as a dentist, registration certificate may be collected from doctors registering on the Platform. If you are an entity/organization offering/providing dental services (“Dental Company”) registering on the Platform, then information such as name and address, contact details, billing details, payment methods including but not limited to card details, UPI ID,  website of Your company, business registration numbers and tax-related information may also be collected. 

Treatment- related Information: Information pertaining to treatment, including but not limited to the brand of the products being used by the end user, doctor prescriptions, schedule of using the product, chats related to the doctors pertaining to treatment and any information regarding the product being used in the treatment may be collected.   

Audio, video and images: Information such as Your photograph, audio and video calls with the doctors may also be collected by the Platform. 

Registration-related information: Information such as referral codes and other registration-related information shall also be collected by the Platform. 

Other information: We may also collect information about the IP address and the browser you are using.  

 

You agree and voluntarily consent to provide correct and accurate information. We shall not be liable for any inaccuracies in the information provided by You or any direct or indirect consequences of such inaccurate information. If we find out, either on our own or through any other means that You have provided false information, we shall be at liberty to restrict your access to the Platform/Website and our services. You agree and acknowledge that activities such as impersonation and/or providing false/inaccurate information and/or providing medical advice contrary to the law, amounts to fraud. We are at liberty to pursue criminal and civil remedies available under the law, if we find out that you are committing fraud or we suspect of You committing fraud, we shall in addition to other remedies, at our sole discretion, report You to relevant authorities, including but not limited to the police.  

How does the Company collect Information 

Information provided to the Company 

We may ask for Information, as outlined above, at the time of Your registration on the Platform and during the course of Your using of the Platform. In addition to the above, We may also collect information from You, through marketing and promotional materials including but not limited to, newsletters, marketing tools and campaigns. You willingly consent to provide the Company your Personal Information at the time of registration on the Platform/Website. 

 

Information collected automatically 

Some data such as your browser type, internet protocol address used, your usage patterns may be automatically collected by the Company using cookies. Cookies are tiny pieces of information which a website sends to Your computer. We use Cookies to provide you with a more personalized experience on the Platform/Website. You can change Your browser settings and choose to disable sharing of information through cookies. Sometimes, tracking pixels including but not limited to browser HTML pixels may be used to collect information about user behaviour on the Platform/Website. Pixels are tiny units which measure the digital images and graphics you see on a website. You agree that Cookies and Pixels are used to improve your experience as an end-user and consent to the use of the same.  

 

Information we may receive from third parties: 

We may receive information about you from third parties. For example, if you access our platform/websites or services through a third-party connection or log-in, for example, through your social media accounts, or using Your email address, that third party may pass certain information about your use of its service to the Company. This information could include, but is not limited to, the user ID associated with your account (for example, your Google, Apple, Twitter, or Instagram User ID), an access token necessary to access that service, any information that you have permitted the third party to share with us, and any information you have made public in connection with that service. When you use our Platform, third parties might give us some information about you, especially if you are signed into a third party account while using our Platform. 

 

What Purposes is the Personal Information Collected Used For? 

The purposes for which the Company uses the data collected are:  

Verifying your identity: The contact details collected may be used to verify your identity. You agree that such verification is essential for the Company to run the Platform/Website smoothly and to comply with its legal and other obligations. 

Personalizing your experience on the Platform: The information collected from you would help the Company in personalizing your experience and providing you a better and more efficient service. 

Assisting you in procuring the services offered on the Platform. 

Assisting You in procuring the services offered by Our partner platforms. 

Improving the design and style of the Platform.  

Developing new products, features, services and functionality.  

Communication regarding marketing and promotion of products/services.  

To meet our government, legal and judicial obligations. 

You agree that the aforementioned purposes are valid and give Your informed consent to the collection of Your Personal Information for such purposes.  

How long will the Personal Information collected be retained by the Company? 

Subject to applicable laws, any information that is provided by you may be retained by the Company, at its sole discretion for as long as required for commercial purposes of the Company.  

Whom does the Company share Your Personal Information with? 

The Company may share Your Personal Information, with:  

Third-party business partners: We may share your information with third-party business partners (practice management platforms or other partners) including but not limited to Dental Companies for the purpose of providing the Service to you. Those business partners will be given limited access to your information as is reasonably necessary to deliver the Service. We may share your information directly with such third-party business partners or through APIs, 

Employees/Consultants: The Company may share your information with its employees and consultants.  

Service-Providers registered on the Platform: Service Providers such as doctors registered on the Platform may have access to Your data and information. 

End Users: If You are a doctor registered on the Platform, Your information may be shared with end-users such as patients availing the services offered. 

Parents/ Guardians – In case if patients are teens. We may share their data with their parents/guardians. 

Compliance with law: The Company can share your information when compelled by a government agency, law, regulation, a court or other legal process.  

You willingly and based on informed consent, agree to the sharing of your Personal Information with the aforementioned. You agree that You shall not hold the Company liable if Your Personal Information is unauthorizedly disclosed or misused by the aforementioned.  

Rights of the User 

You shall have the following rights under this Privacy Policy:  

Right to Request access to Your Personal Information: You may, at any point of time, after You have consented to the collection of Your Personal Information, access the same through the Platform/Website.  

Right to Request correction of Your Personal Information: You may, during anytime, after You have consented to the collection of Your Personal Information, request us to correct or update the same, by sending an email to info@dental-stack.in. You may also choose to update the information, Yourself, by editing the information in Your account on the Platform. You shall be solely responsible for the failure to get Your Personal Information corrected or updated.  

You may request us to practicably delete Your Personal Information by sending us an e-mail on info@dental-stack.in.  

You may request us to restrict the processing of Your Personal Information or raise objections related to the processing of Your Personal Information. In the event the restrictions requested impede us in providing the Services, we may have to restrict Your access to the Platform/Website and/or not provide you seamless Services.  

You may request that we transfer the Personal Information that We have collected to some other organization or directly to You.  

We shall practicably respond to Your requests within a minimum of 30 working days. In the event you choose to invoke any of the aforementioned rights, kindly inform us within a time period of 15 days after you provide the information to Us, failing which, We may not be able to entertain such requests.  

GDPR 

If you are an EU based user, among other rights, You also have the right to: 

Ask whether we process personal information about you, and if we do, to access data we hold about you and certain information about how we use it and who we share it with. 

Request that we delete the personal information we hold about you in certain limited circumstances. 

Request that we stop processing the personal information we hold about you. 

Object to our processing of data about you.

If You are a California based User, among other rights, You also have the right to:  

Obtain disclosure regarding the specific categories and pieces of Personal Information collected in reference to You.  

Prohibit the selling of Your Personal Information, if such sale is happening.

We are required by law to maintain the privacy of our patients’ protected health information (“PHI”). We are also required to provide notice of our legal duties and privacy practices with respect to PHI and to abide by the terms of the Notice of Privacy Practices currently in effect. We reserve the right to change the terms of this Notice and to make a new Notice effective for all PHI we maintain.

This notice applies to all US citizens who use, access and share their PHI on or through the Platform.  

Use and Disclosures of Your PHI That does not require Authorization 

Your PHI may be disclosed to and for the following purposes without the need for an explicit authorization from You: 

(1) To the Individual who is the subject of the information (unless required for access or accounting of disclosures);  

(2) Treatment, Payment, and Health Care Operations;  

(3) Opportunity to Agree or Object;  

(4) Incident to an otherwise permitted use and disclosure;  

(5) Public Interest and Benefit Activities; and  

(6) Limited Data Set for the purposes of research, public health or health care operations. 

 

Communications 

We will use your PHI to communicate with you about a number of important topics, including information about appointments, your care, treatment options and other health-related services as offered on the Platform. We may also contact you at the email, phone number or address that you provide, including via text messages, for these communications. If your contact information changes, it is important that you let us know. Texting and email are not 100% secure. Regarding text messages, please note that message and data rates may apply and you will have an opportunity to opt out 

Use and Disclosure of Your Information for which Authorization is required 

Except as outlined above, we will not use or disclose your PHI for any other purpose unless you have signed a form authorizing the use or disclosure. You may revoke an authorization in writing, except to the extent we have already relied upon it. In some situations, a signed authorization form is required for uses and disclosures of your PHI, including but not limited to:  

uses and disclosures for marketing purposes  

uses and disclosures for certain research protocols  

as required by applicable privacy law.  

You agree and acknowledge that the Protected Health Information as collected by the Platform is in the nature of ‘minimum necessary information’ that is required to be collected for you to avail the services as provided under this Platform. 

Any recurring or routine disclosures shall be as per policies formulated/adopted by Us in compliance with applicable law. 

Your Rights as a User 

Access to Your PHI: . Generally, you can access and inspect paper or electronic copies of certain PHI that we maintain about you. You may readily access much of your health information without charge by contacting us at info@dental-stack.com.  

Amendments to Your PHI: You can request amendments, or changes, to certain PHI that we maintain about you that you think may be incorrect or incomplete.  

Accounting of Disclosures of Your PHI: In accordance with applicable law, you can ask for an accounting of certain disclosures made by us of your PHI. This request must be in writing and signed by you or your representative. This does not include disclosures made for purposes of treatment, payment, or health care operations or for certain other limited exceptions. An accounting will include disclosures made in the six years prior to the date of a request. 

Restrictions on use and disclosure of your PHI: You can request restrictions on certain of our uses and disclosures of your PHI for treatment, payment, or health care operations. We are not required to agree but will attempt to accommodate reasonable requests when appropriate.  

Breach notification: We are required to notify you in writing of any breach of your unsecured PHI without unreasonable delay and no later than 60 days after we discover the breach. 

Paper copy: You can obtain a paper copy of this Notice, even if you agreed to receive an electronic copy by contacting us on info@dental-stack.com.  

 

How do we protect your information? 

We protect Your information by employing the following measures:  

We have put in place various physical and technical security measures to protect the Personal Information we collect from you.  

We require those with whom we share Your Personal Information to enter into confidentiality arrangements with us so that they do not disclose Your personal information. We shall not be liable for any data loss, unauthorized disclosure or any direct or indirect damage arising out of in connection with the disclosure of data by third-parties.  

By complying with all applicable laws and regulations.  

You acknowledge and agree, that the Company cannot possibly guarantee absolute protection against loss of information. As internet is susceptible to unforeseen security issues, we can only make reasonable efforts to protect Your Personal Information, but cannot give an absolute guarantee regarding the same.  We shall not be liable in the event, Your Personal Information is unauthorizedly disclosed on account of improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss of information, or any security breach which is beyond the reasonable control of the Company.  

Minor User 

If You are a Minor User, that is a User who has not attained the age of majority in their respective jurisdiction, then You represent and warrant that any Information You share shall be through Your parents/guardians and/or with their consent. We shall not be held liable for any information provided by You in violation of this provision. 

Third Party Websites 

Some content on the Platform may contain links to third-party websites or Platform. If You choose to click on such links, You would be re-directed to a third-party website. Please note that, Our terms of use and privacy policy cease to apply as and when You are redirected to a third party website. You are advised to read the privacy policy of such third-party website before You submit any Personal Information on such a website. We shall not be responsible for any loss of information which may occur on such third-party websites. We are not liable to obtain your consent for third-party’s privacy policy. 

Changes to Privacy Policy 

There may be changes to this Privacy Policy from time to time. The last effective date shall be highlighted at the top of policy information. You shall be solely liable to review the Privacy Policy for any changes. The Company is not obliged to intimate You regarding the changes.  

Force Majeure 

You agree that You shall not hold the Company responsible or liable for any non-performance of any obligations under this Privacy Policy, if such non-performance arises due to events including but not limited to:  

Floods, fire earthquakes or any natural disaster or acts of god. 

Riots, war or any such act of violence.  

Epidemics/Pandemics 

Unprecedented technical errors including but not limited to network errors, unforeseen down time of the internet and power outages affecting internet services. 

Hacking 

Global internet shutdowns. 

Any change in applicable laws.  

Any other reason beyond the Company’s control. 

Limitation of Liability 

You further agree, that You shall not hold the Company liable for any unauthorised disclosure or leakage of your Personal Information, directly or indirectly, by the Company or any third-party. The Company shall not be liable for any indirect, consequential or remote damages arising out of or in connection with this privacy policy.  The total liability of the Company in the event of breach of this privacy policy shall not exceed INR 1000.  

Governing Law and Jurisdiction 

All matters, claims and any other such issues which may directly or indirectly arise from or in connection with this Privacy Policy shall be governed under the laws of Mumbai. The courts at Mumbai shall have the sole and exclusive jurisdiction to hear all matters, claims or any such issues which may directly or indirectly arise from or in connection with this Privacy Policy.
